1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and vigcheck LLC, a Wyoming limited liability company (“vigcheck,” “we,” “us,” or “our”), governing your access to and use of the vigcheck platform, including the website at vigcheck.io, all associated web applications, mobile applications, APIs, and related services (collectively, the “Service”).
By creating an account, uploading data, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (incorporated herein by reference), and any additional terms applicable to specific features. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms.
2. Eligibility
You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is not directed to individuals under 18. We do not knowingly collect personal information from anyone under 18. If you are accessing the Service on behalf of a law firm, treatment center, or other organization (“Organization”), you represent and warrant that you have authority to bind that Organization to these Terms.
3. Description of Service
3.1 Platform Overview
vigcheck is an AI-powered financial analysis platform that processes bank transaction data to identify, categorize, and analyze gambling-related financial activity. The Service provides transaction categorization, net win/loss calculations, behavioral pattern analysis, narrative reports, and data visualizations. The Service is offered in the following capacities:
- Individual Users (B2C): Personal gambling financial analysis, behavioral tracking, and AI-assisted insights.
- Legal Professionals (B2B): Litigation-support reports with court-ready formatting, audit trails, and methodology documentation.
- Clinical Professionals (B2B): Behavioral data reports to supplement clinical assessment workflows for gambling disorder treatment.
3.2 Data Ingestion Methods
The Service accepts financial data through the following methods: (a) manual upload of bank statements in PDF or CSV format; (b) bank account connection via third-party data aggregation services such as Plaid (when available); and (c) manual transaction entry.
4. Automated Analysis Disclaimer
4.1 AI-Generated Outputs
vigcheck uses artificial intelligence, including third-party large language models provided by OpenAI and Anthropic, to categorize transactions, detect behavioral patterns, and generate analysis reports. ALL OUTPUTS PRODUCED BY THE SERVICE, INCLUDING BUT NOT LIMITED TO TRANSACTION CLASSIFICATIONS, PLATFORM IDENTIFICATIONS, BEHAVIORAL RISK FLAGS, NARRATIVE REPORTS, NET WIN/LOSS CALCULATIONS, AND LITIGATION REPORTS, ARE AUTOMATED ESTIMATES GENERATED BY AI SYSTEMS. They are not certified financial statements, audits, forensic analyses, or expert opinions.
4.2 Probabilistic Nature of AI
AI classifications are probabilistic in nature. The system may produce false positives (classifying a non-gambling transaction as gambling) or false negatives (failing to identify a gambling transaction). Behavioral pattern detection relies on algorithmic analysis of transaction timing, amounts, and frequency, and may not accurately reflect your actual behavior or intent.
4.3 No Guarantee of Accuracy
While vigcheck employs commercially reasonable efforts to maintain classification accuracy, we do not guarantee that any analysis, report, or output will be complete, accurate, current, or error-free. The accuracy of results depends directly on the quality, completeness, and authenticity of the data you provide.
5. User Verification Responsibility
You are solely responsible for reviewing and verifying all transaction classifications, platform identifications, behavioral assessments, and financial summaries produced by the Service. The Service provides a review and confirmation step specifically for this purpose. You must not rely on unverified AI outputs for personal decisions, legal proceedings, clinical assessments, or professional advice.
By proceeding past the confirmation step, you represent that you have reviewed the classifications presented to you and accept responsibility for any outputs generated based on your confirmed data. vigcheck shall have no liability for any harm arising from your failure to review or correct AI classifications.
6. Not Professional Advice
NOTHING PRODUCED BY VIGCHECK — INCLUDING ANALYSIS RESULTS, BEHAVIORAL PATTERN REPORTS, CHAT RESPONSES, LITIGATION REPORTS, OR ANY OTHER OUTPUT — CONSTITUTES FINANCIAL, LEGAL, MEDICAL, THERAPEUTIC, OR PROFESSIONAL ADVICE OF ANY KIND.
The Service is an analytical tool designed to help you understand your financial transaction history. Specifically:
- The Service is not a medical device and has not been evaluated, cleared, or approved by the U.S. Food and Drug Administration or any other regulatory authority.
- Behavioral pattern analysis is not a clinical diagnosis of gambling disorder or any other mental health condition. It is a data-driven observation intended for informational purposes only.
- Litigation reports are intended to support, not replace, professional legal analysis by qualified attorneys.
- The AI chat feature provides informational responses about your data and is not a substitute for licensed counseling, therapy, or crisis intervention.

7. Litigation Reports — Special Terms
7.1 Intended Use
Litigation-ready PDF reports generated by the Service are intended to support legal analysis conducted by qualified attorneys. They are designed to organize and present financial transaction data in a structured format with methodology documentation and audit trail information.
7.2 No Expert Testimony
vigcheck does not serve as an expert witness, provide testimony, or participate in legal proceedings on behalf of any user. We do not guarantee that any report will be accepted by courts, regulatory bodies, tribunals, opposing counsel, or any other adjudicative body. Admissibility of AI-generated evidence is subject to evolving legal standards, including Federal Rule of Evidence 702 and the proposed Rule of Evidence 707 governing AI-generated evidence.
7.3 Attorney Review Required
All litigation reports must be reviewed by a qualified attorney before use in legal proceedings. The attorney is responsible for determining the report’s fitness for the specific legal context, supplementing it with independent expert analysis as appropriate, and ensuring compliance with applicable rules of evidence and procedure.
7.4 Methodology Transparency
Each litigation report includes a methodology section describing the AI models, classification logic, and confidence thresholds used. vigcheck publishes this methodology to support reproducibility and expert review. However, vigcheck is not obligated to produce source code, algorithmic weights, proprietary prompts, or trade secret information in response to discovery requests, subpoenas, or other compulsory process directed at vigcheck.
8. User Accounts
8.1 Account Creation
You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
8.2 Account Security
You must immediately notify vigcheck at security@vigcheck.io if you become aware of any unauthorized use of your account or any security breach. vigcheck will not be liable for any loss arising from unauthorized use of your account where you have failed to maintain adequate security of your credentials.
8.3 Account Termination
You may terminate your account at any time through the account settings page or by contacting support@vigcheck.io. vigcheck may suspend or terminate your account at any time for violation of these Terms, suspected fraudulent activity, or for any other reason at our sole discretion, with notice where practicable. Upon termination, your right to use the Service ceases immediately. Data deletion following account termination is governed by Section 11 and our Privacy Policy.
9. Acceptable Use
You agree not to use the Service to:
- Upload fabricated, altered, or fraudulent bank statements or transaction data.
- Generate reports containing false or misleading information for use in legal proceedings or any other purpose.
- Attempt to reverse-engineer, decompile, or extract the AI models, prompts, algorithms, or trade secrets underlying the Service.
- Access the Service through automated means (bots, scrapers, crawlers) without prior written authorization.
- Use the Service in connection with any illegal activity or in violation of any applicable law or regulation.
- Resell, sublicense, or redistribute any reports or outputs from the Service without written authorization.
- Upload data belonging to another individual without that individual’s informed, written consent.
- Attempt to circumvent any security, authentication, or access control measures of the Service.
10. Fees and Payment
10.1 Pricing
The Service offers both free and paid tiers. Current pricing is displayed on the billing page within the Service and at vigcheck.io. Prices are stated in U.S. dollars unless otherwise indicated. vigcheck reserves the right to change pricing with thirty (30) days’ advance notice.
10.2 Subscriptions
Paid subscriptions renew automatically at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You may cancel at any time through the billing settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused portions of a billing period.
10.3 B2B Pricing
Pricing for legal professionals and clinical professionals is governed by the applicable service tier selected at registration or as set forth in a separate written agreement. Per-matter pricing for litigation reports is charged at the time of report generation.
10.4 Taxes
All fees are exclusive of applicable taxes. You are responsible for paying any sales tax, use tax, value-added tax, or similar tax imposed on your use of the Service by any governmental authority.
11. Data Retention and Deletion
11.1 Retention Schedule
vigcheck retains your data according to the following schedule:

11.2 Deletion Requests
You may request deletion of your data at any time by contacting privacy@vigcheck.io or through the account settings. Deletion requests are processed within forty-five (45) days, with a possible forty-five (45) day extension for complex requests upon notice. Deletion is subject to the following exceptions: (a) data required for compliance with legal obligations; (b) data subject to a litigation hold; (c) audit logs required for regulatory compliance; and (d) data that has been anonymized and aggregated such that it can no longer be associated with you.
12. Intellectual Property
12.1 vigcheck's Intellectual Property
The Service, including all software, algorithms, AI models, prompts, user interface designs, documentation, and trademarks, is owned by vigcheck LLC and protected by United States and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except the limited license to use it as provided herein.
12.2 Your Data
You retain all ownership rights to the bank statements, financial data, and other information you upload to the Service. By uploading data, you grant vigcheck a limited, non-exclusive, revocable license to process your data solely for the purpose of providing the Service to you. vigcheck does not claim ownership of your data and will not sell, share, or use your data for any purpose other than providing and improving the Service, as described in our Privacy Policy.
12.3 AI-Generated Reports
Reports and analyses generated by the Service using your data are jointly created outputs. You have a non-exclusive, perpetual license to use, copy, distribute, and modify any reports generated from your data for any lawful purpose, including submission in legal proceedings. vigcheck retains the right to use anonymized, aggregated patterns from report generation to improve its AI models and Service quality.
13. Third-Party Services
The Service integrates with third-party services, including but not limited to Plaid Inc. (bank data aggregation), OpenAI (AI classification), Anthropic (AI report generation), Google Cloud Platform (infrastructure), and Stripe (payment processing). Your use of these third-party services is subject to their respective terms of service and privacy policies. vigcheck is not responsible for the availability, accuracy, or practices of third-party services.
When you connect a bank account through Plaid or similar services, you authorize vigcheck to access your financial transaction data through that service in accordance with our Privacy Policy and the third party’s terms.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WITHOUT LIMITING THE FOREGOING:
- VIGCHECK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
- VIGCHECK DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED ANALYSIS, CLASSIFICATION, BEHAVIORAL ASSESSMENT, OR REPORT.
- VIGCHECK DOES NOT WARRANT THAT ANY REPORT WILL BE ADMISSIBLE IN ANY COURT OR PROCEEDING, OR THAT ANY BEHAVIORAL ANALYSIS WILL BE CLINICALLY ACCURATE.
- VIGCHECK DOES NOT WARRANT THAT THE SERVICE WILL IDENTIFY ALL GAMBLING TRANSACTIONS IN YOUR DATA OR THAT ALL IDENTIFIED TRANSACTIONS ARE CORRECTLY CLASSIFIED.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. TO THE EXTENT SUCH EXCLUSIONS ARE NOT PERMITTED, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
15. Limitation of Liability
15.1 Exclusion of Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIGCHECK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM:
- INACCURATE TRANSACTION CLASSIFICATIONS OR BEHAVIORAL PATTERN ASSESSMENTS
- RELIANCE ON UNVERIFIED AI-GENERATED OUTPUTS
- USE OR REJECTION OF REPORTS IN LEGAL PROCEEDINGS
- CLINICAL DECISIONS MADE BASED ON VIGCHECK REPORTS
- LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
15.2 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIGCHECK’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS PAID BY YOU TO VIGCHECK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
15.3 Applicability
The limitations in this section apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if vigcheck has been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, vigcheck’s liability is limited to the maximum extent permitted by law.
16. Indemnification
You agree to indemnify, defend, and hold harmless vigcheck and its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your submission of AI-generated reports in legal proceedings; (d) your uploading of data you did not have the right to process; (e) claims that your use of the Service infringes the rights of a third party; or (f) your failure to review and verify AI classifications as required by Section 5.
17. Dispute Resolution
17.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
17.2 Mandatory Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. The arbitration shall be conducted in Cheyenne, Wyoming, or at a mutually agreed location, by a single arbitrator. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
17.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action against vigcheck.
17.4 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm. Claims arising under consumer protection statutes that prohibit pre-dispute arbitration agreements are also excluded to the extent required by applicable law.
18. International Users
The Service is operated from the United States. If you access the Service from outside the United States, you do so at your own initiative and are responsible for compliance with local laws. By using the Service, you consent to the transfer of your data to the United States, subject to the protections described in our Privacy Policy, including the EU-US Data Privacy Framework, UK Extension, and Standard Contractual Clauses where applicable.
For users located in the European Economic Area, United Kingdom, or Australia, additional rights and protections are set forth in our Privacy Policy, including rights related to automated decision-making and data subject access requests.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.
20. Entire Agreement
These Terms, together with the Privacy Policy and any applicable service-specific agreements (such as B2B subscription agreements), constitute the entire agreement between you and vigcheck regarding the Service and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral.
